Religious Institutions: Update - March 8, 2010

In addition to offering summaries of recent court decisions involving religious institutions that have to do with sovereign immunity and claims for damages under the Religious Land Use and Institutionalized Persons Act, this alert reviews some of the key reasons for a faith-based organization to ask a church-state lawyer to review its employment and admissions policies every few years. Among these reasons are maximizing available legal defenses specific to religious institutions, such as the church-autonomy and ecclesiastical abstention doctrines – and religious institutions’ expectations of officers, employees and others that may differ from those of secular organizations.

On March 19, 2010, the U.S. Supreme Court could decide whether or not to accept an appeal of the Second Circuit decision in The Shipping Corporation of India v. Jaldhi Overseas Pte Ltd. This alert provides a short summary of the seminal Supplemental Rule B Jaldhi appeal, the certiorari process before the Court, the process if certiorari is granted, and the ways in which Jaldhi has affected the Supplemental Rule B process during the past six months.
