Recent developments in the interpretation and application of the Clean Water Act's (CWA) jurisdiction have drawn attention to the question of discharges of pollutants to groundwater with a hydrological connection to surface water. Two U.S. Court of Appeals circuits recently issued rulings impacting this discussion, the U.S. Environmental Protection Agency has received hundreds of written comments in response to its February 2018 request, and a recent Senate hearing discussing the issue broke along party lines. What is going on, and how is the regulated community expected to keep up with this evolving topic?
