Is There a Bankruptcy Common Law?

Bankruptcy, Restructuring and Creditors' Rights attorney Barbra Parlin will speak at the American Bankruptcy Institute's (ABI) New York City Bankruptcy Conference. Ms. Parlin's session will focus on the idea of common law for bankruptcy matters. The speakers will explore questions such as whether applicable law should be the default position, what the rule of necessity is, when bankruptcy common law may be appropriate and how bankruptcy law has evolved. Other topics will include first-day orders, standing, U.S. Trustee issues, exculpation and third-party releases, and the solvent debtor exception.
