On March 1, 2024, in National Small Business United, d/b/a the National Small Business Association, et al. v. Yellen, et al., a federal judge in the U.S. District Court for the Northern District of Alabama entered a final declaratory judgment, concluding that the Corporate Transparency Act (CTA) exceeds the Constitution's limits on Congress' power and enjoining the U.S. Department of the Treasury and the Financial Crimes Enforcement Network (FinCEN) from enforcing the CTA against the plaintiffs.

The Treasury Department will likely appeal the court's order and ask for a stay pending appeal.
