California's 2021 Housing Laws: What You Need to Know
Although 2020 was a largely dismal session in terms of significant housing production legislation, some new laws will affect housing projects and operations in specific ways, and new tenant protection laws could affect housing operators. On October 14, Holland & Knight land use attorneys Chelsea Maclean, Andrew Starrels, Daniel Golub and Kevin Ashe discussed notable new laws that affect housing project applicants and provide entitlement extensions, as well as changes to Senate Bill (SB) 35, State Density Bonus Law, and laws relating to Accessory Dwelling Units (ADUs), Housing Element planning efforts and the California Environmental Quality Act (CEQA) amendments in light of the ongoing housing crisis, the COVID-19 pandemic and other crises. The presentation offered practical tips on how to apply the best aspects of each law to your project through a mix of entitlement and litigation strategies. The attorneys also previewed what might be on the horizon in terms of housing and entitlement streamlining efforts by state lawmakers and Gov. Gavin Newsom's administration.
