The Human Memory and How to Address it in Arbitration
International Arbitration attorney Adolfo Jiménez moderated a conversation for the Miami International Arbitration Society (MIAS) with José Astigarraga, Co-Chair of the ICC Task Force. They discussed a recent report issued by the ICC detailing its worldwide task force focused on the effect of human memory on witness evidence. This report, several years in the making, addresses human memory as it affects international arbitration. The task force commissioned psychological research into how practices followed in international arbitration can affect memory and therefore witness testimony. This presentation provides an overview of the task force’s findings and recommendations as well as some insights revealed by the input received from the task force’s members from across the globe.
