The Attorney/Client Privilege Under Attack

Holland & Knight's Tax Controversy and Litigation Team hosted a discussion about important attorney-client privilege concerns. Attorneys Kevin Packman, Andrea Darling de Cortés and James Dawson covered the basics of attorney-client privilege, when it applies, what it protects and how it differs from other evidentiary privileges. They also explored the decision denying en banc review by the U.S. Court of Appeals for the Fifth Circuit in Taylor Lohmeyer Law Firm P.L.L.C. v. United States and its potential impact, including several unresolved questions that should be of concern to both law firms and clients.
