Real Estate attorney Natalia Cuberos wrote a publication for the law program at the Pontificia Universidad Javeriana about Colombian Law 1676 of 2013, which offers a system of collateral guarantees applicable in both civil and commercial matters. Ms. Cuberos says this new system expanded the real estate spectrum and established execution mechanisms that allow the guarantee to be carried out judicially or extrajudicially or even to appropriate the asset given as guarantee. Ms. Cuberos discusses the process of issuing the law in the country, its background, the expansion of the real estate spectrum and some mechanisms for the execution of the guarantees. She also offers a comparison analysis of real estate security in other countries such as Mexico, France and the United States.
