Electric Cooperative Receives Favorable Interpretation of Excess Revenue Statute and Class Action Dismissal

In Simmons v West Florida Electric Cooperative Association, Inc., an excess revenue statute, the court held that it is a Florida statute requirement that a cooperative distribute excess revenues "unless otherwise determined by a vote of the members" was fulfilled when members voted to adopt bylaws.
