Bound and Determined: The Power of A Virginia Zoning Determination
The Virginia State Bar Real Property Section's fall 2018 issue of the Fee Simple journal includes an article on the state's zoning determination by Holland & Knight land use attorneys Michelle Rosati and David Schneider.
As the authors point out, zoning is one of the few areas of law that touch every business, resident and landowner in a state. Thus, Virginia's zoning administrator's power over the interpretation and construction of zoning ordinances is very vast and is not to be underestimated.
To help those who might need to engage counsel and appeal an adverse determination or a notice of violation related to land use and zoning law, Ms. Rosati and Mr. Schneider include a series of allegorical scenarios developed to illustrate important principles and provide reference to current legal decisions and statutory developments that can be used in the representation of clients dealing with similar interpretation and enforcement issues.
