"Trends in Leasing Arrangements," Steve Kirkham in Chain Store Age
Waller's Steve Kirkham wrote an article, featured in Chain Store Age, discussing the latest trends in real estate law. Among those trends, specific to leasing arrangements, are the below findings:
- There is a definite trend of stores downsizing the square footage of their facilities. It has also become common among landlords to break up larger spaces and offer smaller spaces to a number of stores as opposed to the old "big box" shop.
- Small space means smaller product lines means more exclusivity. There is also an increased need to protect product lines when there are fewer products on the shelves.
- Increased popularity among landlords of charging lower base rent and higher percentage rent.
- Though landlords have traditionally included a termination provision in leasing agreements, the right to terminate has become a more mutual affair; often agreements give the right to both the tenant and the landlord.
