Litigation Partner Josh Roberts authored a section in the January 2021 edition of Pratt's Privacy & Cybersecurity Law Report about a case currently before the U.S. Supreme Court regarding the Computer Fraud and Abuse Act (CFAA). The Court has been asked to interpret what it means to “exceed authorized access” to a computer under CFAA. Whether a citizen can be criminally convicted of a federal felony, or subject to a civil judgment, hinges on how that phrase is interpreted. Mr. Roberts discusses the arguments on both sides.
