DoD’s New IP Rules May Impact Contractors’ Rights in Computer Software and Technical Data
Government Contracts Partner Christian Nagel and Associate Kelsey Hayes co-authored an article in the March 2021 edition of Pratt’s Government Contracting Law Report discussing the U.S. Department of Defense's (DoD) proposed revisions to the Defense Federal Acquisition Regulation Supplement. The revisions are designed to shift intellectual property rights terms from the current standard to terms that are more individualized by contract—resulting in ownership and license rights that are more favorable to the government and less favorable to contractors.
