ABA Stance on Role of Nonlawyers Is Too Black and White
Legal Ethics attorneys Peter Jarvis and Trisha Rich co-authored a Law360 article discussing Resolution 402, a recent decision made by the American Bar Association's House of Delegates that states the "sharing of legal fees with non-lawyers and the ownership or control of the practice of law by non-lawyers are inconsistent with the core values of the legal profession" and that there should consequently be no changes to the ABA Model Rules of Professional Conduct. The article analyzes the ABA's decision and explains why allowing nonlawyers to play a greater role in the delivery of legal services will likely be a necessary part of moving forward.
