What Affordable Housing Developers Should Know About Emerging Contaminants
Environmental attorney Dianne Phillips wrote an article for Affordable Housing Finance addressing important considerations for affordable housing developers regarding emerging contaminants, particularly per- and polyfluorinated compounds (PFAS). The Environmental Protection Agency (EPA) has updated its standards, and the new American Society for Testing and Materials (ASTM) standard E1527-21 should be used for all new projects starting from February 23, 2023. Ms. Phillips explains that although PFAS compounds are still being assessed for hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), they are of concern and have become regulated by several states. Developers should stay informed about EPA's rulemaking on PFAS, as it can impact affordable housing projects in terms of water quality and project budgets.
