Trade Dress: What Is It and How Is It Protected?

Intellectual Property attorney Ana Sofía Cabrales published an article in Asuntos Legales analyzing the concept of a trade dress. According to the author, trade dress refers to the combination of distinctive elements that comprise the external appearance that identifies a product, service or business establishment, such as the design on packaging or colors on a logo. Unlike other jurisdictions, Colombia does not expressly regulate the trade dress, but there are other options for protecting these elements, including trademarks.
