First-of-Its-Kind Artificial Intelligence Law Addresses Deep Fakes and Voice Clones

Attorneys Catie Lane Bailey, Tanisha Pinkins and Lauren Caverly Pratt co-authored an article in The Computer & Internet Lawyer discussing the Ensuring Likeness Voice and Image Security (ELVIS) Act of 2024. The new Tennessee law gives artists artificial intelligence (AI) protections for their name, image, likeness and voice, as the technology is now able to simulate and clone individuals. The ELVIS Act replaces the state's Personal Rights Protection Act (PPRA) of 1984, assuring that an artist's actual or simulated voice is a protected property right, which could be enforced civilly and criminally as a Class A misdemeanor.
