New Guidelines for Energy Projects Regarding COD

Energy attorney Ernesto Guzmán published a column in Asuntos Legales about the new guidelines for energy projects regarding the Commercial Operation Date (COD). Mr. Guzmán analyzes Energy and Gas Regulatory Commission (CREG) Resolution 101 049 of 2024, which establishes two alternatives for modifying the COD: by increasing the guarantee — or without an increase in cases of force majeure — or delays in SIN expansion works. The author highlights that these measures will reduce procedures for Mining and Energy Planning Unit (UPME) but transfer greater risks to project owners for delays beyond their control, such as in permit and license applications.
