U.S. Strengthens Export Controls on Advanced Computing Items, Semiconductor Manufacturing Items

International Trade attorneys Robert Friedman and Molly O'Casey and International Law Clerk Jingwen Xing wrote an article featured in The Global Trade Law Journal discussing the U.S. Bureau of Industry and Security's (BIS) Final Rule and Interim Final Rule concerning circuit production and advanced computing and semiconductor manufacturing. These rules, effective Dec. 2, 2024, implement tighter export controls on advanced computing and semiconductor manufacturing items, including 140 new additions to the Entity List. The authors explore the implications of these rules, such as new Foreign-Direct Product regulations and increased controls on high-bandwidth memory, targeting China's strategic capabilities. Additionally, the article highlights the U.S. and China's ensuing trade responses, including China's export bans on critical minerals.
