Mass. Celebrity Chef Wins 'Milk Street' Trademark Fight

Holland & Knight attorneys successfully defended CPK Media, founded by celebrity chef Christopher Kimball, in a lawsuit claiming that he violated Milk Street Cafe Inc.'s trademark by opening a cafe named Milk Street Kitchen. The judge ruled that because there was little to no potential for overlap between each business' clients — Milk Street Cafe being a kosher cafe with a local focus and Milk Street Kitchen offering cooking lessons with a national reach and a large social media presence — the two named were unlikely to be confused, and so Milk Street Cafe failed demonstrate the trademark infringement would cause harm.
