Is CFIUS Doubling Down on Non-Notified Transactions from Russia?
CFIUS and Industrial Security attorney Antonia Tzinova was interviewed by Foreign Investment Watch about increased scrutiny from the federal government on transactions involving Russia. The Committee on Foreign Investment in the United States (CFIUS) has reportedly been closely investigating non-notified transactions (NNTs) from Russian investors, some of which are nearly 10 years old. Ms. Tzinova commented that these reports are not surprising, given that a geopolitical development like the war in Ukraine often creates new opportunities for CFIUS scrutiny.
"Given this and the administration's general response to Putin's invasion of Ukraine, it is natural to expect an increased scrutiny of non-notified transactions, and possibly some notified transactions where CFIUS finds changed circumstances," she explained.
