New IRS Pass-Through Unit Is No Quick Fix to Partnership Worries

Tax Controversy and Litigation attorney Mary McNulty was quoted in a Bloomberg Tax article about the new unit that the Internal Revenue Service (IRS) is forming to tackle concerns around pass-through entities and taxcode reform. The IRS' new unit is said to be staffed by 3,700 employees that the agency plans to hire using Inflation Reduction Act funding.

“It’s really ambitious,” Ms. McNulty stated. “It can only work if the applicant pool is there, and the training is done. So, it will take time.” She suggested the IRS wait until it can complete more audits to get a better sense of whether any problem merit changes to the law. If reforms are needed, they could be difficult to push through.

“I think there’s plenty of law that just hasn’t been able to be enforced,” Ms. McNulty said. “I don’t think we need any more changes in the law. I think we need the increased enforcement activity to see if there are problems, and if there are widespread problems the IRS is able to identify, then we can look at what changes in the law are needed to address those.”
