DOJ Says Boeing Breached Its DPA
Aviation attorney Benjamin Allen was quoted in a Global Investigations Review article discussing the U.S. Department of Justice's (DOJ) recent determination that Boeing breached its 2021 deferred prosecution agreement (DPA). The DOJ cited issues with Boeing's compliance program as whole, leadership support of compliance with fraud laws and the company's policy review schedule. As the DOJ weighs its next steps, including potential further prosecution, Mr. Allen noted that the agency is likely closely examining Boeing's cooperation with other federal agencies, such as the National Transportation Safety Board (NTSB), in their investigations of incidents like the recent 737 MAX door plug failure. He also emphasized the importance of providing information to government agencies during investigations to avoid potential obstruction-of-justice charges.
“If they find evidence of a significant crime during an investigation, they will notify appropriate authorities,” he said.
