Top International Tax Cases of 2024: Midyear Report
Tax attorney Joshua Odintz was mentioned in a Law360 article examining significant international tax rulings over the last six months. He commented on the noteworthy case Moore v. United States, where the U.S. Supreme Court upheld the mandatory repatriation tax (MRT) established in the Tax Cuts and Jobs Act of 2017. This case stemmed from Charles and Kathleen Moore's challenge to the tax after a stake they held in the Indian company KisanKraft was taxed under the MRT. Mr. Odintz explained how taxpayers could use the high court's reasoning in future legal challenges to the tax code in circumstances where income may not be realized. He said the Internal Revenue Service (IRS) would have lost tax revenue if the court had found the repatriation tax unconstitutional.
