Attorneys Break Down DOJ's RealPage Antitrust Suit

Antitrust attorney Kenneth Racowski was quoted in a Law360 article discussing the potential impacts of the U.S. Department of Justice's (DOJ) lawsuit against RealPage on pending private litigation concerning rental price-fixing. Mr. Racowski noted the DOJ's finding that landlords accepted RealPage's pricing recommendations roughly 40 to 50 percent of the time, a statistic he believes could significantly influence the outcome of private lawsuits. Furthermore, he elaborated on the distinction the DOJ made between using non-public versus public data in algorithms, underscoring the subtleties that could benefit defendants in related cases.

"Landlords [who are] currently defendants in private litigation are going to really like the fact that they said recommendations are only accepted 40-50%. It's a potentially dispositive problem for the private litigations," he said.
