Disney Made Right Move Dropping Arbitration Bid, Attys Say

Litigation attorney David Cannella was quoted in a Law360 article discussing the latest updates in a case Disney faces over a woman's fatal allergic reaction after eating at the Raglan Road Irish Pub and Restaurant in Disney Springs. The company decided to stop trying to use its Disney+ app agreement to arbitrate the claims brought forth by the woman's husband, Jeffrey Piccolo. Disney had previously argued he had consented to a binding arbitration provision when creating an online Disney account to use the app in 2019. Mr. Cannella said Disney should consider a more robust defense, such as not owning or operating the restaurant.

"Landlords typically would not be responsible for such events, so I think that's a solid defense, and it's going to be up to the court whether the argument carries the day," he explained.
