"Several of the Reform Proposals Present a Risk of Unconstitutionality"
Asuntos Legales
Tax attorney Juan Carlos Valencia was interviewed by Asuntos Legales about the tax reform recently proposed by the Colombian government. Mr. Valencia analyzed the main aspects of the proposal, highlighting the most affected sectors, the risks of unconstitutionality and the implications for different groups of taxpayers. He also expressed concern about the negative impact the reform could have on economic recovery and questioned the effectiveness of some of the measures.
"Several of the proposals included in the reform present a high risk of unconstitutionality. It is clear that a surcharge on the mining sector, even in periods of low prices, as is being proposed, would lead this industry to face effective tax rates close to 100 percent, falling again into measures of a confiscatory nature," he said.
