New Rules Won't Lift Political Clouds Over Hydrogen Projects

Tax attorney Elizabeth Crouse was quoted in a Law360 article discussing the challenges and opportunities surrounding the new rules for hydrogen production tax credits (PTC) under Section 45V of the Internal Revenue Code. The article highlighted how the Biden Administration's final guidelines add flexibility for hydrogen projects but face uncertainty because of forthcoming changes in the administrative and congressional makeup. Ms. Crouse provided insights into how these rules – while they remain in place – could be beneficial for developers and investors in the evolving hydrogen market.

"My beginning-of-construction day can be closely tied to my investment decision. So that's extremely useful for developers and does make these rules much more easily implemented. And it makes the 45V credit more attractive to investors as well," she said.

Ms. Crouse recently co-authored a Holland & Knight alert on the PTC final regulations.
