Overview
Luis Garcia is a regulatory attorney in Holland & Knight's Miami office. Mr. Garcia focuses his practice on helping banks, financial institutions and companies navigate complex regulations and enforcement actions related to all facets of consumer financial services.
As a member of Holland & Knight's Consumer Protection Defense and Compliance Team, Mr. Garcia has experience defending clients subject to investigations and inquiries by the Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), U.S. Small Business Administration (SBA), U.S. Department of Justice (DOJ) and state attorneys general. He advises clients on all aspects of investigations, from responses to civil investigative demands (CIDs) through advocacy before the agencies and settlement negotiations.
Mr. Garcia has significant knowledge of multiple federal and state consumer protection statutes, including the Dodd-Frank Wall Street Reform and Consumer Protection Act (Dodd-Frank Act), Federal Trade Commission Act (FTCA), Telephone Consumer Protection Act (TCPA) and other regulations implemented by various regulators. He is also well versed in advising clients on unfair, deceptive or abusive acts or practices (UDAAPs). In addition, Mr. Garcia conducts due diligence and evaluates risks of FTC- and U.S. Food and Drug Administration(FDA) regulated entities in commercial transactions.
As a member of Holland & Knight's White Collar Defense and Investigations Team, Mr. Garcia focuses his practice on corporate internal investigations, compliance and white collar criminal defense, with special attention to matters arising from or connected to Latin America.
In addition, Mr. Garcia regularly advises domestic and multinational companies on issues relating to bribery under the Foreign Corrupt Practices Act (FCPA), anti-money laundering (AML), Bank Secrecy Act (BSA) and economic sanctions administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC). Leveraging his fluency in Spanish, Mr. Garcia has handled matters related to Argentina, Chile, Colombia, Guatemala, Mexico and Venezuela.
Finally, Mr. Garcia rounds out his practice with federal and state litigation in a wide range of matters. He also actively participates in the pro bono representation of parents and children in connection with proceedings under the Hague Abduction Convention.
While in law school, Mr. Garcia served as judicial intern to the Honorable John J. O'Sullivan and the Honorable Lurana S. Snow of the U.S. District Court for the Southern District of Florida. In addition, he was executive managing editor of the Florida Law Review. He also served as president of the Latino Law Students Association.
