Todd Hambidge is a litigation attorney in Holland & Knight's Nashville office. Mr. Hambidge is a skilled and formidable litigator who is trusted and respected by both clients and colleagues. He is a relentless advocate for clients known for his incisive ability to distill complex issues and disputes to their core. Highly responsive and attentive, Mr. Hambidge brings a personal commitment to solving problems for clients across a wide range of industries.

In his intellectual property (IP) litigation practice, Mr. Hambidge defends the IP rights of technology companies, media clients, consumer products manufacturers and retailers in cases involving:
- misappropriation of trade secrets
- trademark infringement, dilution and counterfeiting
- copyright infringement
- patent infringement
In the financial services arena, Mr. Hambidge has defended numerous banks and financial institutions against claims brought under the Fair Credit Reporting Act, the Fair Debt Collection Practices Act (FDCPA), and other federal and state laws and regulations. He has successfully obtained dismissal of several Americans with Disabilities Act (ADA) actions against community banks in connection with ATM functionality and successfully obtained dismissal on behalf of a debt portfolio company in numerous FDCPA cases in multiple jurisdictions.
Additionally, Mr. Hambidge has extensive experience with First Amendment law and defends media clients in connection with print, online, and television content from claims of libel and false light invasion of privacy. He also represents media clients and news-gathering organizations with issues involving open courts, public records and the Tennessee shield law. He has successfully represented a major newspaper company in connection with open court issues and high-profile public records litigation.
Mr. Hambidge's more general business litigation practice focuses primarily on contractual disputes, fraud, tortious interference, unfair competition and statutory compliance.
Previously, he was a litigator in the New York office of a global law firm.
Representative Experience
- Successfully defended a nutraceutical company against breach of contract and tortious interference claims; complete defense jury verdict
- Successfully defended an insurance company and its subsidiary against claims of trade secret misappropriation, tortious interference with contract and other business-related claims; on the two claims the jury found in favor of the plaintiff, it awarded less than 2 percent of the compensatory damages plaintiff demanded
- Successfully defended a well-known out-of-state law firm in a trademark and copyright case; the court granted a motion to dismiss the majority of plaintiff's claims and the case settled shortly thereafter
- Successfully defended a national vacation club against statutory claims; the court granted a motion to dismiss; dismissal affirmed by the Tennessee Court of Appeals
- Successfully defended a major energy company's U.S. subsidiary in litigation brought by the former operator of multiple gas station convenience stores; obtained summary judgment and dismissal of the majority of the plaintiff's claims with remaining claims settled shortly thereafter
- Successfully represented a major consumer electronics company in its first anti-counterfeiting case; the court granted an ex parte seizure order and temporary restraining order, and the case settled shortly thereafter
- Successfully represented a major consumer products manufacturer in multiple trademark and trade dress cases; the court granted preliminary injunctions in all cases, with the cases settling shortly thereafter
- Successfully secured an arbitration decision in favor of a national electronics retailer in a trademark action against it by a major international electronics manufacturer
- Successfully defended media organizations against defamation claims in multiple lawsuits
- Successfully obtained dismissal of putative class action cases against debt portfolio company
- Successfully obtained dismissal of several Americans with Disabilities Act actions against community banks in connection with ATM functionality
