Overview

Greg Hoffnagle is a business attorney in Holland & Knight's New York office and has practiced in the insurance and financial services industry for nearly 20 years. Mr. Hoffnagle guides (re)insurers, insurance technology companies (InsurTechs), emerging and technology companies, venture capital and private equity firms, and other insurance-related service providers through cutting-edge compliance, regulatory and transactional matters.

With a particular focus on the intersection of insurance and technology, a considerable part of Mr. Hoffnagle's advisory work involves working with clients to create innovative products and bring them to market quickly, from choosing an operating structure and advising on licensing and regulatory issues, to strategic investments and acquisitions.

Mr. Hoffnagle also spends an increasing amount of time representing clients whose primary industry is not insurance (e.g., logistics, shipping, marketplace, automotive, cannabis, ride-sharing, property management, sports, ecommerce, retail, telecommunication and manufacturing) with respect to the creation and implementation of niche insurance, product warranty, service contract and protection (assurance) programs for their customers.

In addition to his regulatory and transactional practice, Mr. Hoffnagle is also an experienced litigator for complex insurance and reinsurance-related disputes, as well as governmental investigations and enforcement actions. He is also a trusted adviser for companies and institutions on risk management issues and complex insurance claims.

Prior to joining Holland & Knight, Mr. Hoffnagle was an attorney at an international law firm in its New York office.

  • Advise numerous insurance technology (InsurTech) companies on insurance regulatory and transactional matters, including with respect to embedded insurance products and offerings involving wearables, cannabis, ride-sharing, boating, rentals, cyber risks, and homeowners and auto insurance

  • Advised a global online financial services company on insurance regulatory and innovative product development issues
  • Advised an online lending marketplace on complex insurance regulatory and product development issues

  • Advised a digital currency exchange and custodian on cutting-edge insurance products and coverages

  • Advise an insurance producer and a home warranty company in defending against regulatory inquiries, investigations and enforcement actions
  • Advised a global manufacturing technology trade association in a highly complex $42 million claim related to the association's forced cancelation of its biannual trade show as a result of the COVID-19 pandemic
  • Advised a major international retrocessionaire in an American Arbitration Association (AAA) arbitration and related litigations in the U.S. and Brazil against a state-owned Brazilian reinsurance company in a dispute arising out of a $750 million loss to an iron ore processing plant in Brazil
  • Advised an international manufacturer in a first-party property claim stemming from a catastrophic roof collapse to one of its factories in northern Spain
  • Advised a Bermuda insurance company in a London arbitration with respect to a coverage dispute relating to a major environmental catastrophe stemming from the Tennessee Valley Authority's coal fly ash slurry spill
  • Advised a United Kingdom (U.K.)-based reinsurer in a $30 million reinsurance arbitration dispute involving rescission of a large workers' compensation program
  • Advised a Panamanian reinsurer in a $15 million reinsurance arbitration dispute with a U.S. retrocessionaire involving dozens of automatic and facultative reinsurance
  • Advised an international company in bankruptcy litigation concerning a purported assignment of rights to seek insurance coverage under policies that were assigned by the insured to the liquidating trust
  • Advised several Lloyd's syndicates in a dispute with their insured, a Mexican energy company, concerning business interruption losses caused during the expropriation of its hydroelectric power plant
  • Advised an international energy mutual in a Bermuda Form arbitration concerning a $350 million claim stemming from catastrophic losses of offshore oil platforms in the North Sea
