Overview
David D. Hornbeak is a Houston litigation attorney who focuses his practice on complex commercial and business litigation in state, federal and arbitration venues both in trial courts and on appeal. Mr. Hornbeak represents clients operating in a wide variety of industry sectors, including financial services, maritime, insurance and oil and gas. Mr. Hornbeak also has extensive experience representing parties in high-stakes disputes involving business dissolutions and acquisitions.
Mr. Hornbeak regularly handles multimillion-dollar commercial matters before and after litigation ensues. He has extensive experience in matters involving oil and gas assets and operations, alleged violations of trade-secret statutes (state and federal), alleged violations of non-compete and non-solicitation agreements, product liability and commercial fraud.
Mr. Hornbeak's litigation experience also includes representing a range of transportation clients, from charterers and shippers in disputes related to charterparties, demurrage, environmental claims and other maritime matters, to internationally based air carriers in breach of contract disputes and personal injury. Similarly, he defends clients in personal injury and wrongful death actions, including claims covered by the Jones Act.
In the financial services industry, Mr. Hornbeak defends credit services organizations, credit access businesses, banks, creditors, debt buyers and third-party collateral recovery companies in financial litigation involving alleged violations of city ordinances; Texas state laws such as the Certificate of Title Act, Deceptive Trade Practices Act (DTPA), Texas Debt Collection Act (TCDA), and other provisions of the Texas Business and Commerce Code and Texas Finance Code; and federal laws, including the Fair Debt Collection Practices Act (FDCPA). Additionally, he supports clients resolving disputes that arise out of accounts receivable financing, or factoring, agreements.
Mr. Hornbeak routinely helps clients navigate issues involving insurance, including coordinating coverage under their own policies, those of third-parties and subrogation. He is often asked to analyze insurance as well as defense and indemnity obligations in commercial contracts, purchase agreements and other complex agreements.
Prior to joining Holland & Knight, Mr. Hornbeak was a litigator with a Texas-based law firm in its Houston-area office. While there, he represented a diverse group of clients on matters pertaining to business disputes, insurance coverage, subrogation and construction defect.
During law school, Mr. Hornbeak served as a judicial intern to the Honorable Terry Jennings of Texas First District Court of Appeals. He also worked as a pro bono mediator throughout the Houston area and served as a coach on his law school's International Baseball Arbitration Competition team, a moot court-type competition based on Major League Baseball salary arbitration proceedings.
