Overview

Kris Reed is an intellectual property (IP) attorney in Holland & Knight's Dallas office. Mr. Reed focuses his practice on IP litigation and counseling.

Mr. Reed represents clients in such diverse fields as electronics, semiconductor manufacturing and development, software, telecommunications, transportation, entertainment, retail and consumer goods, and financial transactions. He has extensive experience in all aspects of federal district court litigation and U.S. International Trade Commission (ITC) investigations and trials.

As a registered patent attorney, Mr. Reed has a wealth of knowledge and experience in post-grant proceedings before the U.S. Patent Trial and Appeal Board (PTAB), having served as lead counsel in more than 50 inter partes review (IPR) proceedings. He is also certified as a National Advisory Expert in China for Overseas Intellectual Property Dispute Settlement.

In addition to his legal practice, Mr. Reed represents foreign parents, often on a pro bono basis, in international child abduction cases under the Hague Convention on the Civil Aspects of International Child Abduction. He has served as lead counsel in multiple trials, resulting in the successful return of illegally retained children to their home countries.

Prior to joining Holland & Knight, Mr. Reed was an attorney at global law firm in its Dallas office and previously served as the managing partner of its Shanghai office. He also completed a federal clerkship with the Honorable Robert C. Jones of the U.S. District Court for the District of Nevada. While in law school, he served as Editor-in-Chief for the Stanford Technology Law Review.

Prior to joining the legal profession, Mr. Reed worked as a software engineer for one of the nation's largest technology companies, developing cutting-edge design automation tools for very large-scale integration (VLSI) microprocessor design. He also worked as a researcher for the National Institute of Standards and Technology (NIST) in Boulder, Colorado, conducting research into next-generation wireless standards and measurement techniques.

Representative Experience

  • Represented a global semiconductor technology company and argued for all appellees in a landmark U.S. Court of Appeals for the Federal Circuit case of an inter partes review (IPR) decision filed by a public university, resulting in a precedential opinion holding that state sovereign immunity does not apply in IPR proceedings before the U.S. Patent and Trademark Office (USPTO); the case was named one of the "Top Patent Cases of 2019" by Law360
  • Defended the a midwestern transit authority and related vendor companies in a patent infringement litigation dealing with contactless credit card technology; obtained an order invalidating four of the five patents-at-issue before trial and achieved dismissal with prejudice of the last patent following the claim construction hearing; judgment was affirmed by the Federal Circuit on appeal
  • Defended two auto parts companies as respondents before the U.S. International Trade Commission (ITC) in an investigation brought by subsidiaries of an American truck company related to truck tonneau covers; following expert discovery, the complainants conceded defeat and withdrew the complaint, resulting in a complete victory for the respondents
  • Defended an American multinational designer, developer, manufacturer and global supplier of a wide range of semiconductor and infrastructure software products, along with its six downstream customers, in a Section 337 investigation before the ITC brought by  multinational technology company related to semiconductor chip packaging technology
  • Represented a global semiconductor technology company and an integrated circuit components company as complainants in a Section 337 investigation before the ITC involving video decoder and wireless local area network patents; following trial, the administrative law judge determined that the USITC should enter an exclusion order against the respondent's products
  • Defended a global semiconductor technology company and an American data storage company in a Section 337 investigation before the ITC brought by an American technology company involving semiconductor memory technology; following trial, the administrative law judge determined that all asserted patents were invalid and that no violation of Section 337 occurred
  • Represented a global semiconductor technology company as complainant in a Section 337 investigation before the ITC involving numerous participants in the semiconductor manufacturing industry
  • Defended a global coffee retailer, a coffee manufacturer, a consumer electronics retailer, an upscale kitchen accessories store chain, and an upscale home furnishing store chain in a patent infringement litigation regarding stored value card transactions; obtained summary judgment of noninfringement on all claims; judgment was affirmed by the Federal Circuit on appeal
  • Defended a world leader in the manufacture and sale of optical lenses against claims of patent infringement; obtained summary judgment on nearly all of the plaintiff's claims; judgment was affirmed by the Federal Circuit on appeal
  • Represented defendant a worldwide leader in electronic component design and manufacturing in a jury trial, resulting in a verdict of only $1.5 million, despite a claim for more than $30 million in damages; the case later reached the U.S. Supreme Court
  • Represented a window blinds and coverings retailer as patent owner in eight IPR proceedings filed against four patents asserted in litigation against a competitor; successfully argued that six of the IPR trials should not be instituted and limited the two instituted IPR trials to just three claims total
  • Defended two cellular companies in a patent litigation in Las Vegas involving "push-to-talk" walkie-talkie cellphones; obtained a favorable settlement on the night before trial
  • Defended a leading manufacturer and seller of premium children's products against claims of patent infringement, trade dress infringement and unfair competition, resulting in all claims being dismissed with prejudice
  • Represented a worldwide leader in electronic component design and manufacturing as plaintiff in a patent infringement litigation against a competitor manufacture of alarm system components; obtained favorable settlement, resulting in the defendant leaving the specific industry
  • Defended a leading manufacturer and seller of premium children's products against claims of trademark infringement, including obtaining denial of the plaintiff's preliminary injunction request following an evidentiary hearing

  • Successfully represented an Australian father in proceedings under the Hague Convention on the Civil Aspects of International Child Abduction (Hague Convention); obtained a verdict ordering return of the children to Australia following a trial on the merits and ordering the defendant mother to pay all of the father's attorney's fees and costs
  • Successfully represented a New Zealand father pro bono in proceedings under the Hague Convention; obtained a verdict ordering return of the child to New Zealand following a trial on the merits
  • Successfully represented a Mexican mother pro bono in proceedings under the Hague Convention; obtained a verdict ordering return of the child to Mexico following a trial on the merits
