Adrienne E. Dominguez is a trial attorney in Holland & Knight's Dallas office, where she focuses her practice on intellectual property (IP) and commercial disputes relating to complex technologies. She has represented national and international clients in cases involving patent and copyright infringement and misappropriation of trade secrets claims, with particular experience in patent infringement and trade secrets damages. Her experience includes presenting and defending various damages models based on a variety of theories, such as comparisons to prior licenses, benefits analyses based on consumer surveys, cost savings benefits, lost-profits analyses and apportionment of product revenues. She has litigated numerous matters involving standard-essential patents and breach of fair/reasonable and nondiscriminatory (F/RAND) issues.

Ms. Dominguez's experience covers trials in federal and state courts as well as administrative proceedings before the U.S. International Trade Commission (ITC), where she has performed analyses relating to economic aspects of alleged U.S. domestic industries associated with asserted patents. She has received recognition for her work in the area of patent damages, including damages investigations centered on patents related to industry standards.

In addition, Ms. Dominguez has litigated complex commercial matters involving recovery of healthcare benefits, antitrust, class action and breach of contract lawsuits. She has extensive experience in supporting the negotiation of technology licenses and agreements.

  • Represented a major airline company in a case filed in the U.S. District Court for the Northern District of Texas regarding unauthorized website access, obtaining finding of personal jurisdiction over foreign defendant
  • Defended an in-office procedural services provider in matters involving recovery of healthcare benefits against several major insurance companies in the Northern District of Texas
  • Represented several Fortune 500 energy companies in multimillion-dollar ad valorem tax cases involving claims of systematic undervaluations of property, resulting in dismissals of all such claims
  • Represented a major tire manufacturer in a class action involving shop fees at tire centers in Oklahoma State Court; successfully overturned class certification in Oklahoma Supreme Court, affirmed by the U.S. Court of Appeals for the Fifth Circuit
  • Represented a major tire manufacturer in breach of contract suit against carbon black supplier in Western District of Oklahoma and Texas state court

  • Defended an international semiconductor manufacturer in an infringement suit related to the 90-nanometer, 65-nanometer, 45-nanometer and 32-nanometer semiconductor manufacturing technologies in the U.S. District Court for the Eastern District of Texas
  • Represented a leading designer and supplier of a broad range of analog, digital, mixed signal and optoelectronics components, subsystems and semiconductors against a leading designer of digital televisions, Blu-ray players and gaming systems in the U.S. District Court for the Central District of California
  • Defended an international semiconductor manufacturer in a Section 337 proceeding in the U.S. International Trade Commission (USITC) relating to bond-pad technology
  • Defended an international semiconductor manufacturer in a Section 337 proceeding in the USITC relating to semiconductor manufacturing technology
  • Defended an international semiconductor manufacturer in a patent infringement suit related to semiconductor processing technology in the Central District of California, obtaining summary judgment and resultant dismissal

  • Represented a telecommunications company in arbitration matters brought by consumers alleging unauthorized porting of mobile numbers
  • Represented a patent owner in an infringement suit involving power-management patents applicable to mobile devices in the U.S. District Court for the Eastern District of Texas; obtained settlement before trial after favorable claim construction
  • Represented a patent owner in an infringement action on several patents relating to Power-over-Ethernet (PoE) protocols in the Eastern District of Texas, obtaining jury verdict of infringement and validity
  • Defended a telecommunications manufacturer and a wireless handset manufacturer in patent infringement matter in the Eastern District of Texas involving 3G telecommunications standard, resulting in jury finding of noninfringement and invalidity
  • Defended an international telecommunications equipment company in a patent infringement action relating to asynchronous transfer mode (ATM) switching technology in the Eastern District of Texas; obtained stay of litigation pending reexamination of patent-in-suit

  • Defended a managed care organization (MCO) in a multimillion-dollar trade secret dispute, obtaining favorable pre-trial resolution
  • Defended a manufacturer/supplier of innovative and high-performance downhole motor power sections used in drilling directional and horizontal wells against allegations of breach of contract and misappropriation of trade secrets in the U.S. District Court for the Southern District of Texas
  • Defended a healthcare technology company in action alleging breach of contract and misappropriation of trade secrets in U.S. District Court for the Northern District of Texas
  • Defended a national mortgage company against copyright infringement/trade secret misappropriation and breach of contract claims relating to software for processing mortgages in the Northern District of Texas
  • Represented a major tire manufacturer in action against a competitor and former employees for misappropriation of trade secrets, breach of fiduciary duty, tortious interference with contracts and breach of contract in Texas state court; obtained a temporary restraining order (TRO).
