HR Toolkit Series, Part 2: Fair Credit Reporting Act
Holland & Knight Webinar
Please join attorneys from Holland & Knight's Labor, Employment and Benefits Group for the second presentation in our six-part HR Toolkit Series.
Background checks of job applicants or employees must comply with the Fair Credit Reporting Act (FCRA). In "Part 2: Fair Credit Reporting Act Class Actions," Partners Kelly-Ann Cartwright and Erika Royal will focus on the legal requirements under the FCRA, from the proper forms to use for disclosure and authorization, to what an employer may and may not do once a background check has been ordered, to how employers must also ensure that their third-party consumer reporting agency vendors comply with the law.
Topics include:
- an overview of the FCRA, including recent updates
- legal obligations before obtaining a background check
- employer requirements before and after taking an adverse action based on a background check
- "Ban the Box" states
- possible penalties and liability under the FCRA
- best practices
