International Trade attorneys Antonia Tzinova and Andrew McAllister will participate in the 7th National Forum on FOCI in Washington, D.C. The annual event offers practical takeaways for managing heightened national security threats for companies under Foreign Ownership, Control or Influence (FOCI), including interactions with the Defense Counterintelligence and Security Agency (DCSA) and Committee on Foreign Investment in the United States (CFIUS).
Ms. Tzinova will join a panel comparing DCSA and CFIUS processes for companies that find themselves beholden to both agreements. Speakers will explain where the two agencies align and diverge, how to accomplish expectations from each organization while avoiding operational challenges and when a mandatory filing obligation arises. They will also show the connection between CFIUS and FOCI mitigation and export controls, along with the timing for both types of submissions.
Mr. McAllister will moderate a discussion on best practices for handling FOCI agreements, including the dos and don'ts of working with the DCSA, addressing FOCI concerns early and budgeting the business impact of FOCI mitigation. The conversation will also cover when to seek legal counsel versus hiring a consultant, in addition to how to implement a FOCI mitigation agreement with limited resources.
