New Immigration Order
Immigration attorney Leon Fresco examined an expected executive order by the Biden Administration that would give undocumented immigrants who are married to U.S. citizens a path to citizenship in the latest episode of the Bloomberg Law Podcast. Currently, if someone crosses the border illegally and marries a U.S. citizen, they cannot simply get a green card. They would instead have to leave the country and apply for a waiver. Mr. Fresco explained that the anticipated new process will allow undocumented immigrants to stay in the country, receive parole and become eligible to apply for a green card after marrying a U.S. citizen.
Mr. Fresco also discussed an executive action by President Biden on June 4, 2024, which ceases asylum claims at the border. In response, a coalition of immigrant advocacy groups have filed a lawsuit against the action.
