Mr. García explained that it is unlawful for landlords to demand cash deposits or require tenants to sign promissory notes or letters as a guarantee. He also highlighted that contracts cannot prohibit tenants from keeping pets or having minors reside in the property. Furthermore, he clarified that tenants should not bear the costs of all repairs; they are responsible only for accessory aspects, while fundamental improvements for the preservation of the dwelling must be jointly assumed with the landlord.
“The only deposit that can be required from the landlord is to guarantee payment of home services when these are the responsibility of the tenant,” he said.
