Influencer Style Case Risks More Stolen Vibe Suits from Creators

Fashion and entertainment attorney Danielle Garno was quoted in a Bloomberg Law article discussing a legal dispute between two social media influencers regarding alleged copying of content and style. Influencer Sydney Nicole Gifford filed a lawsuit against fellow influencer Alyssa Sheil, accusing her of imitating outfits, poses and overall aesthetic after a joint photo shoot and bringing claims of copyright and trade dress infringement. The lawsuit raises questions about the application of copyright and trade dress laws to social media aesthetics. Ms. Garno expressed skepticism with Gifford's chances of success in the case, especially "in a sea of influencers that like trends and have the same sort of aesthetic and vibe."
"Are we really gonna have copyright infringement for hands on a table?" she said, adding that similarities are inevitable when multiple influencers are being paid to promote the same products, presumably with similar instructions.
