Texas Biz Court Costs Unlikely to Be Prohibitive, Experts Say

Litigation attorney Rich Phillips was quoted in a Law360 article discussing the Texas Supreme Court's fee schedule for the state's new business court, which will handle complex commercial disputes exceeding $5 million. The new fee schedule includes a $2,500 filing fee, $50 fees for certain motions and a minimum $300 jury fee. Mr. Phillips mentioned that the fees are intended to support the court's operations and may be adjusted several times during the first few years as its workload becomes clearer.

"It always will be a little bit of a guessing game because you're not going to know how many cases are going to be filed each year. But as they get some experience I think they'll have a better way to estimate how many cases will come in," he said.
