Preparation Counts: Handling Difficult Witnesses
Litigation attorney Dan Small was quoted in a Corporate Disputes issue about the importance of witness preparation for court proceedings. He emphasized that even intelligent and successful individuals cannot simply rely on their ability to "tell their story" in court without thorough preparation because of the unnatural and intimidating nature of the witness environment. Mr. Small pointed out that effective witness preparation is crucial yet often ignored by lawyers, despite its role as a key component for success in any case.
"Witness preparation is one of the most important – and yet underrated – parts of any case. Too many lawyers – even some very good ones – fail to understand how unnatural and difficult the witness environment is," he said.
