Intellectual Property attorney Danilo Romero was cited in an El Tiempo article detailing legal and ethical issues that have emerged as a result of the rise of artificial intelligence (AI). The article highlighted environmental impacts of AI technology, in particular the use of water and other natural resources, as well as intellectual property protection. Mr. Romero commented about the debate of authorship surrounding AI-generated works, saying artificial intelligence companies are not necessarily violating copyright law when generating works that emulate the styles of well-known artists and that laws in this area protect only original works derived from human ingenuity.
"If AI-generated works were protected by copyright, this would change the purpose of the legal system, because copyright is aimed at promoting human creativity," he explained. "One of the chief challenges that artificial intelligence poses for the field of intellectual property is that of authorship. As AI becomes more advanced and can create content such as music, art and literature, the question of who should be recognized as the author of these works — the human who designed the AI algorithm or the machine that created the content — arises."
