Platforms Must Be Held Accountable for Hacks or Data Breaches of Social Media Networks
Intellectual Property attorney Camila López was interviewed by Asuntos Legales to explain how users and digital platforms should respond if a social media account is hacked or its data is breached. She clarified that users can request information from the social media network about the use of their personal data, such as how to access, correct or delete their information. Ms. López also highlighted what happens if the company does not respond to this request as well as emphasized the importance of additional measures when companies do not have a physical presence in Colombia, noting that the Superintendence of Industry and Commerce (SIC) has intervened against foreign entities in the past.
"In Colombia, if a company does not respond to a request within 15 business days or if the response is unsatisfactory, the user can approach the Superintendence of Industry and Commerce (SIC), which serves as the authority for personal data protection," she said.
