Trump to Review Outbound Regime, Export Controls, ICTS Rules, More

CFIUS and Industrial Security Team Leader Antonia Tzinova was quoted in a Foreign Investment Watch article exploring what could come of the Trump Administration's review of the Outbound Investment Security Program and other regulations on export controls and foreign investment. In a memo summarizing its "America First" trade policy, the administration included several recommendations aimed at enhancing the country's national security and industrial and manufacturing capabilities, one of which was calling for the U.S. Secretary of the Treasury to review the outbound investment regime and assess whether its controls sufficiently address national security threats. Although it is possible the examination could lead to rescinding the program, industry professionals predicted President Donald Trump will instead keep or even tighten it. Ms. Tzinova pointed out that the idea for such a program came during the first Trump Administration, making it all the more likely the mechanism will remain.

"I think we would have some form of an outbound investment regime, and probably not much different from what the current rule is," she remarked.
