Medical Negligence Brings a Series of Criminal and Civil Actions from Those Affected
Litigation and Dispute Resolution attorney Catalina Gutiérrez was cited in an article published by Asuntos Legales detailing the legal process with respect to medical negligence in Colombia. The article described three types of criminal offenses in these cases – personal injury, manslaughter and lack of care – adding that negligence can also be punished through civil actions. Ms. Gutiérrez advised that if negligence during the procedure causes the death of the person, seeking a medical expert's opinion is recommended to tilt the evidentiary process in favor of the victim.
"This measure is ideal for demonstrating that, in effect, there was a harm and that was caused by the negligent action and/or because of the medical service provider," she explained.
