Overview

David Dowd is a government contracts attorney in Holland & Knight's Tysons office. Mr. Dowd has more than 30 years of experience providing his clients with prompt, practical and efficient advice. His practice focuses on helping government contractors manage their legal and regulatory affairs. He advises companies that sell military systems, information technology, healthcare and engineering services, as well as companies in other industries involved in federal or state procurements.

Mr. Dowd's counsel includes advising clients on commercial items, conflicts of interest, cost allowability issues, treatment of data and other intellectual property rights, defective pricing, contract and subcontract negotiations, contract financing, assignments and novations, small business programs, real estate leasing, Multiple Award Schedule (MAS) program and government-wide acquisition contracts.

Mr. Dowd has experience with transactions involving government contractors, including conducting due diligence, negotiating transactional documents, addressing representations and warranties, and navigating transition and integration matters, such as novations.

In his litigation practice, Mr. Dowd has handled dozens of bid protests regarding procurements valued in excess of $500 million in the areas of aerospace and defense, information technology, engineering and a variety of commercial items.

Additionally, Mr. Dowd has litigated government contract claims in the Civilian and Armed Services Boards of Contract Appeals and U.S. Court of Federal Claims, as well as prime/subcontractor disputes in district court.

  • Advised contractors with regard to transactions involving government contractors, including effects of transactions on existing and pending government contracts
  • Conducted due diligence regarding dozens of proposed acquisitions of government contracting businesses
  • Successfully pursued bid protests regarding military helicopters and other defense articles, infrastructure projects, information technology contracts and healthcare programs, among others
  • Counseled contractors concerning the preparation of requests for equitable adjustment and claims, as well as resolving such matters short of litigation
  • Advised leading manufacturers regarding Defense Production Act and Title III funding, including obtaining funding and identification of associated risks and compliance considerations
  • Counseled contractors through internal investigations and associated disclosures to Inspectors General and suspension and debarment officials
  • Advised companies regarding price reduction and other compliance considerations for Multiple Award Schedule (MAS) contracts
  • Counseled companies regarding treatment of intellectual property under grants and cooperative agreements
  • Assisted companies in addressing domestic preferences and content requirements for procurement contracts and grant funding
