PHASE Is: All Appropriate Inquiry in the Time of PFAS
Environment attorney Amy Edwards was featured on an episode of the American Bar Association podcast Environmental Law Explored offering insights into the challenge of incorporating per- and polyfluoroalkyl substances (PFAS) into Phase I environmental assessments. Because of the U.S. Environmental Protection Agency's (EPA) designation of two PFAS compounds as hazardous substances, professionals conducting American Society for Testing and Materials (ASTM) Phase I environmental site assessments (ESA) must include those compounds in their evaluation. During the podcast, Ms. Edwards covers the uncertainty surrounding these new procedures, talks about how to detect the presence of PFAS at a site and how to manage the associated risks in real estate transactions, plus offers tips for updating due diligence protocols to ensure compliance.
