Reflections on the Admissibility of Unlawful Evidence in International Arbitration
International Arbitration Associate Josafat Paredes authored an article on the admissibility of unlawful evidence in international arbitration for the International Chamber of Commerce Mexico's Pauta 95 Newsletter. In this article, Mr. Paredes explains that "Arbitral tribunals have had to deal with evidence evaluation that has been declared unlawful and therefore inadmissible, an issue that is highly relevant and mostly undiscussed to safeguard the rights of the parties, the process itself, and, ultimately, the enforceability of the arbitration award."
