The Disputes of the Future: The Usual Ones, Renewed
Energy & Natural Resources attorney José Rengifo wrote an article for Diario Occidente focusing on three topics related to the energy and environmental sectors in Colombia. First, he details the results of a study from the American Arbitration Magazine that revealed that Colombia has been the subject of multiple investor arbitration cases, especially in the mining and oil and gas industry. Second, Mr. Rengifo talks about the importance of strategic minerals like lithium and copper for electrification and the global energy transition, as well as the role of judicial certainty for the implementation of mining projects to extract these minerals. Finally, the article describes the legal difficulties associated with the lack of a law for the prior review process for affected communities.
