New Biden Enviro Review Regs Address Climate, Communities

Environment attorney Rafe Petersen was quoted in a Law360 article discussing proposed changes to National Environmental Policy Act (NEPA) regulations by the White House's Council on Environmental Quality. The proposed rule would require agencies to consider climate change and environmental justice effects as part of the review process. Mr. Petersen commented that exemptions created under the Fiscal Responsibility Act (FRA) for projects to avoid NEPA review, if executed properly, could have important ramifications for environmental law.

"When you add it to the page limits and speeding it up, I think this is a very significant change to the grandfather of environmental law... if properly implemented," he said.
